Terms of service

These Terms of Service (hereinafter referred to as the "Terms") establish the conditions of use for the online shop Bath Poster Specialty Store Little Oasis (hereinafter referred to as the "Service") provided on this website by Yamaura Design (Representative: Hideki Yamaura) (hereinafter referred to as the "Company"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application) 
● These Terms shall apply to all relationships between the User and the Company regarding the use of the Service. ● In addition to these Terms, the Company may establish various rules and provisions regarding the Service (hereinafter referred to as "Individual Provisions"). Regardless of their names, these Individual Provisions shall constitute a part of these Terms. ● If any provision of these Terms conflicts with the Individual Provisions of the preceding paragraph, the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.

Article 2 (Registration for Use)
● In the Service, registration shall be completed when an applicant agrees to these Terms, applies for registration by the method specified by the Company, and the Company notifies the applicant of its approval. ● If the Company determines that the applicant falls under any of the following reasons, the Company may not approve the application for registration and shall not be obliged to disclose any reason whatsoever. ● When false information is provided upon application for registration. ● When the application is from a person who has violated these Terms in the past. ● When the Company otherwise determines that the registration is inappropriate.

Article 3 (Management of User ID and Password)
● The User shall manage their User ID and password for the Service at their own responsibility. ● Under no circumstances may the User transfer or lend their User ID and password to a third party, or share them with a third party. When a user logs in with a combination of User ID and password that matches the registered information, the Company will consider it to be used by the User who registered that User ID. ● The Company shall not be liable for any damages caused by the use of a User ID and password by a third party, except in cases of intentional or gross negligence by the Company.

Article 4 (Sales Contract)
● In the Service, a sales contract is established when the User applies to the Company for a purchase, and the Company notifies the User that it has accepted the application. The ownership of the product shall be transferred to the User when the Company delivers the product to the delivery company. ● If the User falls under any of the following, the Company may cancel the sales contract set forth in the preceding paragraph without prior notice to the User. ● If the User violates these Terms. ● If the delivery of the product cannot be completed due to an unknown delivery address or long-term absence. ● If the Company otherwise determines that the relationship of trust between the Company and the User has been damaged. ● Payment methods, delivery methods, cancellation of purchase applications, or return methods, etc., relating to the Service shall be determined separately by the Company.

Article 5 (Intellectual Property Rights) Copyrights or other intellectual property rights of product photos and other content (hereinafter referred to as "Content") provided by the Service belong to the Company and legitimate right holders such as content providers, and Users may not duplicate, reproduce, modify, or otherwise make secondary use of them without permission.

Article 6 (Prohibited Acts) Users shall not engage in the following acts when using the Service.
● Acts that violate laws or public order and morals. ● Acts related to criminal activities. ● Acts that infringe on copyrights, trademarks, or other intellectual property rights contained in the Service. ● Acts that destroy or interfere with the functionality of the Company's servers or network. ● Acts of commercially using information obtained from the Service. ● Acts that may interfere with the operation of the Company's services. ● Unauthorized access or attempts to do so. ● Acts of collecting or accumulating personal information concerning other users. ● Acts of impersonating other users. ● Acts that directly or indirectly provide benefits to anti-social forces in connection with the Company's services. ● Other acts that the Company deems inappropriate.

Article 7 (Suspension of the Service, etc.)

Article 8 (Restriction of Use and Deregistration)
● The Company may restrict the use of all or part of the Service to the User or cancel the User's registration without prior notice if the User falls under any of the following. ● If the User violates any provision of these Terms. ● If it is found that there is a false fact in the registered matters. ● If the credit card registered by the User as a payment method is suspended. ● If there is a default in payment obligations such as fees. ● If there is no response to communication from the Company for a certain period. ● If the Service has not been used for a certain period since the last use. ● If the Company otherwise determines that the use of the Service is inappropriate. ● The Company shall not be liable for any damages caused to the User by actions taken by the Company based on this Article.

Article 9 (Withdrawal) The User may withdraw from the Service by completing the prescribed withdrawal procedure.

Article 10 (Disclaimer of Warranties and Limitation of Liability) 
● The Company does not warrant that the Service is free from factual or legal defects (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, infringement of rights, etc.). ● The Company assumes no responsibility for any damages caused to the User by the Service. However, if the contract between the Company and the User concerning the Service (including these Terms) becomes a consumer contract as defined in the Consumer Contract Act, this disclaimer does not apply. Even in this case, the Company is not liable for damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) among damages caused to the User due to default or tort by the Company's negligence (excluding gross negligence). ● The Company assumes no responsibility for any transactions, communications, or disputes occurring between the User and other Users or third parties in connection with the Service.

Article 11 (Changes to Service Contents, etc.) The Company may change the contents of the Service or discontinue the provision of the Service without notifying the User, and shall not be liable for any damages caused to the User by this.

 Article 12 (Changes to the Terms of Use) The Company may change these Terms at any time without notifying the User if it deems it necessary. If the User starts using the Service after the change of these Terms, the User shall be deemed to have agreed to the changed Terms.

Article 13 (Handling of Personal Information) The Company shall appropriately handle personal information acquired through the use of the Service in accordance with the Company's "Privacy Policy".

Article 14 (Notification or Contact) Notification or contact between the User and the Company shall be made by the method specified by the Company. Unless a change notification is submitted by the User in accordance with a method separately specified by the Company, the Company will consider the currently registered contact information to be valid and will notify or contact that contact information, and these will be deemed to have reached the User at the time of transmission.

Article 15 (Prohibition of Assignment of Rights and Obligations) The User may not assign or pledge their position under the usage contract or the rights or obligations based on these Terms to a third party without the prior written consent of the Company.

Article 16 (Governing Law and Jurisdiction) ● The interpretation of these Terms shall be governed by Japanese law. In regard to the Service, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded. ● In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Company's head office shall be the court of exclusive jurisdiction.
